In Suffolk County, there a number of different types of tickets you can receive for driving with a suspended or revoked license:

• 511.1a Aggravated unlicensed operation in the 3rd degree.

If you have one or two suspensions on your driving record, you will generally be charged with driving with a suspended license in violation of section 511.1a of the New York State Vehicle and Traffic Law. This is also called aggravated unlicensed operation of a motor vehicle in the 23rd degree. This is a misdemeanor charge, and a conviction to it will result in a criminal record.

• 511.2a Aggravated unlicensed operation in the 2nd degree.

If you have 3 or more suspensions on 3 or more dates for failure to respond to tickets or if you license is suspended or revoked as a result of a prior alcohol related offense, then the charge is aggravated unlicensed operation of a motor vehicle in the 2nd degree in violation of section 511.2a of the New York State Vehicle and Traffic Law.

A driver will also be charged with a 511.2a if the original suspension or revocation had resulted from either a conviction for an alcohol or drug related violation or a chemical test refusal or if the original suspension was a mandatory suspension pending prosecution of an alcohol related offense.

This is a more serious misdemeanor charge, and if not reduced, will result in a mandatory sentence of either jail and/or probation in addition to minimum $500 fine plus a surcharge.

• 511.3 Aggravated unlicensed operation in the 1st degree.

A driver may be charged with aggravated unlicensed operation in the 1st degree if the driver has 10 or more suspensions, on 10 or more dates, for failure to respond to tickets or if the driver is impaired or intoxicated with a license or driving privilege currently under suspension or revocation for an alcohol or drug related violation or a chemical test refusal.

This charge is a felony punishable by prison for up to 4 years or 5 years probation or a combination of up to 6 months jail and 5 years probation and a mandatory fine of $500.00 to $5,000.00.
